How Mississippi BUI Law Applies on Public Waters
Boating under the influence isn’t simply a land-based DUI involving a different vehicle. Mississippi Code Section 59-23-7 addresses the operation of covered watercraft on public waters while under the influence of alcohol, impaired by another substance, or at or above the applicable alcohol-concentration threshold.
The Mississippi Alcohol Boating Safety Act includes a .08% alcohol-concentration provision based on an authorized analysis of breath, blood, or urine. Chemical testing involves collecting and analyzing one of these samples for evidence of alcohol or another substance.
Evidence may include officer observations, statements, chemical-test records, video, witness accounts, and reports concerning a stop, boarding, or collision. A rocking vessel, changing water conditions, poor lighting, vessel layout, and the timing of an evaluation can affect how observations are interpreted. Their significance depends on the circumstances.
Mississippi BUI Penalties & Boating Restrictions
Potential penalties generally depend on prior convictions within the statutory period and whether the incident involved death or an injury specified by law. Consequences may include fines, incarceration, community service, boating education, and restrictions on watercraft operation.
Mississippi Code Section 59-23-7 provides for the following potential consequences:
- First conviction: A $250 to $1,000 fine, up to 24 hours in jail, or both, along with completion of a boating safety education course.
- Second conviction within five years: A $600 to $1,000 fine, 48 consecutive hours to one year in jail or community service, and a one-year watercraft-operation prohibition.
- Third conviction within five years: An $800 to $1,000 fine, 30 days to one year in jail, and a two-year watercraft-operation prohibition.
- Fourth or subsequent violation within five years: A felony carrying a potential $2,000 to $5,000 fine, 90 days to five years in prison, and a three-year watercraft-operation prohibition.
During a watercraft-operation prohibition, a person can’t legally operate covered watercraft. Negligent conduct that causes death or certain catastrophic injuries may create separate felony exposure. The specific allegations, available evidence, prior record, and charge level determine which provisions may apply.
