Mississippi’s Touching of a Child for Lustful Purposes Statute

Mississippi commonly prosecutes conduct described as child molestation under Miss. Code Ann. § 97-5-23. Under subsection (1), a person over 18 commits a felony by handling, touching, or rubbing a child under 16 with the hands, body, or an object for the purpose of gratifying lust or indulging depraved licentious sexual desires. The statute applies with or without the child’s consent.

Subsection (2) separately addresses an accused person over 18 who occupies a position of trust or authority over a child under 18. The child must be younger than the accused and not married to the accused. The statute identifies parents, stepparents, legal guardians, teachers, counselors, physicians, ministers, scout leaders, and coaches as examples of people who may occupy such a position.

Mississippi appellate decisions have described molestation, touching, and fondling as interchangeable terms in this statutory context. The terminology alone doesn’t establish guilt. The prosecution must prove the required lustful purpose: that the alleged touching was intended to gratify lust or indulge the sexual desires identified in the statute.

Criminal Penalties & Sex Offender Registration

A conviction under Miss. Code Ann. § 97-5-23 is a felony and a registrable sex offense in Mississippi. The state classifies touching of a child for lustful purposes as a Tier Two offense. This classification generally requires at least 25 years of registration before a person may petition the circuit court for relief from the obligation.

Registration involves more than placement on a public registry. Most registrants must appear in person every 90 days to update their information and submit to a new photograph. Registration can also restrict housing, employment, and travel options. Local ordinances may establish additional boundaries involving schools, parks, and community centers.

A second conviction under § 97-5-23, or for a substantially similar offense from another state, can carry a sentence of up to 20 years. Because the criminal judgment and registration requirements can have lasting effects, we consider the full range of potential consequences from the beginning.

Child Molestation Defense in Madison County, Mississippi

Early defense work can shape how an allegation is investigated and presented. We proactively gather available evidence, examine the prosecution’s account, and scrutinize law enforcement conduct for constitutional violations. We also assess whether the state can prove the alleged act, applicable age requirements, a position of trust or authority when charged, and the required lustful purpose.

Evidence that may require careful review includes:

  • Recorded interviews and statements attributed to the accused or child
  • Digital communications, photographs, and device data
  • Medical, forensic, or investigative records
  • Timelines, witness accounts, and evidence of the surrounding circumstances
  • Searches, seizures, questioning, and other law enforcement actions

Felony proceedings may begin in Madison County Justice Court, which handles preliminary hearings before cases proceed to circuit court. A preliminary hearing addresses whether sufficient probable cause exists for the case to continue. In Mississippi, a felony prosecution generally also requires a grand jury to determine whether probable cause supports a True Bill, an indictment authorizing the charge to move forward.

If the case reaches trial, it’s typically heard in the Madison County Circuit Court in Canton. The process begins with jury selection and continues through the presentation of evidence, witness testimony, legal arguments, and jury deliberations. We prepare for each stage while continuing to evaluate the evidence and available defense options.
